TERMS AND CONDITIONS

Definitions
Except as otherwise and expressly provided for in other specific provisions, the terms listed below have in these General Conditions of Sale, the meaning that is attributed to them in the following definitions:
"Business Day" or "Business Days" means the days on which our offices are open for normal activities (generally every day from 9 to 18 excluding Saturdays, Sundays, holidays and on the occasion of some exceptional circumstances of which we will give you timely news on this site)
"Force Majeure Events" include situations resulting (directly or indirectly) from any strikes, lockouts, fires, floods, proven inability to obtain products, materials or services, failures, delays from suppliers or couriers, government laws or regulations or any other cause or event beyond our control. The above is provided as an example only. There are other events that may have a force majeure character.

Object
These General Conditions of Sale relate to the purchase of Ciocomiti Srl / GmbH products made remotely via the telematic network on the "www.ciocomiti.com" site belonging to Ciocomiti Srl / GmbH, with registered office in Zona Produttiva, 38027 Malè ( TN) Italy. These purchases are reserved for customers, direct users, traders, wholesalers, resellers, professionals, etc. Each purchase transaction will be governed by the provisions of Legislative Decree 185/99 and, as regards the protection of confidentiality, it will be subject to the legislation pursuant to Legislative Decree no. 196/03.

Acceptance of the order - Conclusion of the contract
By sending the online order, the Customer sends to Ciocomiti Srl / GmbH a proposal to purchase the product and / or products included in the cart. When the Customer places an online order for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these General Conditions of Sale.
Ciocomiti Srl / GmbH will send the Customer an e-mail of acceptance and confirmation of the order containing the number, date and total amount of the order as well as the methods of delivery of the product. If, for any reason, Ciocomiti Srl / GmbH is unable to accept the Customer's order (for one of the cases indicated below), it will immediately communicate it to the Customer via the website itself.
In particular, Ciocomiti Srl / GmbH will not accept orders:
- if the material, at the time of the order, is not available in the warehouse (if the material is not available, it will still not be possible to add it to the cart) and / or
- if the customer's credit card issuer does not confirm payment.
Ciocomiti Srl / GmbH nevertheless reserves the right not to accept the order, at its discretion.

Customer commitments
These General Conditions of Sale must be examined online by Customers before submitting their orders. The submission of the order therefore implies their total knowledge and their full acceptance.
The Customer undertakes and undertakes, once the online purchase procedure is concluded, to print and keep these general conditions of sale, already viewed and accepted during the purchase process carried out, in order to fully satisfy the condition of which to the articles 3 and 4 of Legislative Decree no. 185/1999.

Prices
All prices on the site are VAT included.
The prices shown on this site are the sales prices currently in force. In the event that the price of the goods ordered is reported by Ciocomiti Srl / GmbH in a clearly discordant way, the order can be canceled at any time by Ciocomiti Srl / GmbH or by the Customer, provided that before sending the goods, it will be possible reorder the products at the correct selling price.

Payments
The payment of the purchased products and the related shipping costs must be made by the customer when placing the order by using a credit card (Visa, Mastercard, Amex, Postepay), Paypal or bank transfer. In this case Ciocomiti Srl / GmbH will process the order upon receipt of the bank transfer. Ciocomiti Srl / GmbH is not responsible for any fraudulent or illegal use that may be made by third parties of credit cards when paying for the products purchased.

Right of withdrawal
Pursuant to art. 5 DL 185/1999, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his business or professional activity), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.
To exercise this right, the customer must contact the assistance service indicated on the site, follow the instructions that the operator will provide and send a communication to Ciocomiti Srl / GmbH within 10 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to

or by telegram or fax always sent within the aforementioned 10-day period and followed by a confirmation sent by registered letter with acknowledgment of receipt within the following 48 hours.
Once we have received the aforementioned notice of withdrawal, Ciocomiti Srl / GmbH will promptly communicate to the customer the details on how to return the goods.

Important
The customer must apply the label he receives attached to the transport documents to the external packaging of the goods to be returned, where he must write down the information received.
As the only charge, and if the error did not depend on a fact attributable to Ciocomiti Srl / GmbH, the Customer will have to bear the costs of returning the goods.
The goods must be returned intact and in the original packaging, complete with all its parts and without having suffered any damage.
Upon arrival in the warehouse, the goods will be examined and, in the presence of damage or tampering, the withdrawal cannot be exercised
Ciocomiti Srl / GmbH will refund the customer the full amount already paid within the terms of the law. The refund will be made by crediting the amount due on the credit card used by the customer for the purchase being refunded.
It will be the customer's responsibility to promptly provide Ciocomiti Srl / GmbH with any information necessary for a correct and prompt refund procedure.

Complaints
Any complaints must be addressed directly to Ciocomiti Srl / GmbH, after contacting customer support or e-mail to the dedicated address indicated on the site. Ciocomiti Srl / GmbH undertakes to respond to complaints within five working days.

Applicable law and competent court
The sales contract between the customer and Ciocomiti Srl / GmbH is concluded in Italy and regulated by Italian law. For any dispute concerning the validity, interpretation or execution of the same contract, the territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the State.
